3. Collection and Storage of Personal Data as well as the Nature and Purpose of Its Use

 

a) On visiting the website

When you access our website www.sukano.com, the browser used by your terminal device automatically sends information to our website’s server. This information is temporarily stored in a so-called log file. In the process, the following information is captured without any action on your part and stored until it is automatically deleted:

  • Name and URL of the accessed file,
  • Website from which the access is made (referrer URL),

b) On registering for our newsletter

If you have expressly provided your consent in accordance with DSG or, if applicable, Art. 6, para. 1, sentence 1 a GDPR, we use your e-mail address to send our regular newsletter to you. If you wish to receive our newsletter, it is sufficient to provide us with your e-mail address. You can unsubscribe at any time, for example via the link at the end of each newsletter. Our website uses Mailchimp to distribute newsletters. Mailchimp is provided by the Rocket Science Group LLC, 675 Ponce De Leon Ave. NE, Suite 5000, Atlanta, GA 30308, USA. Mailchimp is a service for organizing and analyzing newsletter distribution, among other activities. The data entered by you for the purposes of receiving newsletters (e.g., e-mail address) is saved on Mailchimp’s servers in the United States.

 

Mailchimp is certified in accordance with both the “Swiss-US Privacy Shield” and the “EU-US Privacy Shield.” The “Privacy Shield” is an agreement between Switzerland/the European Union (EU) and the United States and serves to ensure compliance with Swiss and European data protection standards in the United States.

 

Mailchimp helps us analyze our newsletter campaigns. If you open an e-mail sent via Mailchimp, a file contained in the e-mail (a so-called web beacon) connects to Mailchimp’s servers in the United States. This serves to determine whether a newsletter message was opened and what links were clicked on, if any. Technical information (e.g., time of access, IP address, browser type and operating system) is also collected. This information cannot be linked to any specific newsletter recipient. It is only required for carrying out a statistical analysis of newsletter campaigns. The results of these analyses can be used to better customize future newsletters to the recipients’ interests.

 

If you do not want Mailchimp to perform any analyses, you need to unsubscribe from the newsletter. We provide an unsubscribe link in every newsletter message for this purpose. Furthermore, you can also unsubscribe from the newsletter directly on our website.

 

Your data will only be processed with your consent (DSG or, if applicable, Art. 6, para. 1 a GDPR). You can withdraw your consent with future effect at any time by unsubscribing from the newsletter. The lawfulness of any data processing already carried out shall not be affected by this withdrawal of consent.

 

The data you provide us with for the purpose of sending you newsletters is saved by us until such time as you unsubscribe from our newsletter. After you do so, it will be deleted both from our and from Mailchimp’s servers. Data saved by us for other purposes shall not be affected by this.

c) When using our contact form

If you have any questions, you have the option to contact us by means of a form that is available on the website. We require a valid e-mail address to establish who is making the inquiry and to enable us to respond. Any further information is optional.

 

Data processing for the purpose of establishing contact with us in accordance with DSG or, if applicable, Art. 6, para. 1, sentence 1 a GDPR is based on your consent, which you have given voluntarily.

 

The personal data collected by us for the utilization of the contact form is automatically deleted after your query has been resolved.  

 

 

4. Disclosure of Data

Your personal data is not disclosed to third parties for any purposes other than those listed below. We only disclose your personal data to third parties if:

 

  • You have expressly given your consent for this in accordance with DSG or, if applicable, Art. 6, para. 1, sentence 1 a GDPR;
  • The disclosure is required in accordance with DSG or, if applicable, Art. 6, para. 1, sentence 1 f GDPR, for the establishment, exercise or defense of legal claims and if there is no reason to assume that you have a prevailing interest worthy of protection in the nondisclosure of your data;
  • There is a legal obligation for the disclosure in accordance with DSG or, if applicable, Art. 6, para. 1, sentence 1 c GDPR and
  • This is legally permissible and required in order to fulfill our contractual relationships with you in accordance with DSG or, if applicable, Art. 6, para. 1, sentence 1 b GDPR.

 

 

5. Cookies

We use cookies on our website. These are small files, which are automatically created by your browser and stored on your terminal device (laptop, tablet, smartphone or similar) when you visit our website. The analytical and tracking measures listed below and used by us are taken on the basis of DSG or, if applicable, Art. 6, para. 1, sentence 1 f GDPR. We intend to ensure the appropriate presentation and continued optimization of our website with the tracking measures that are being applied. On the other hand, we have applied tracking measures to capture statistics relating to the use of our website and to evaluate such use for the purpose of optimizing our website for you. These are considered to be legitimate interests within the meaning of the abovementioned provisions. a) Google Analytics

For the purpose of the appropriate presentation and continued optimization of our web pages, we use Google Analytics, a web analysis service provided by Google Inc. In this context, pseudonymized user profiles are created and cookies (see Cl. 4) are used. The information gained by cookies about how you use this website, such as

c) Google Adwords Conversion Tracking

To capture statistics relating to the use of our website and to optimize our website for your use, we also use Google Conversion Tracking. For this purpose, Google Adwords places a cookie (see Clause 4) on your computer, provided you have reached our website via a Google ad.

 

These cookies expire after 30 days and are not intended to identify you as an individual. If the user visits certain pages of the website of the Adwords client and the cookie has not yet expired, Google and the client can see that the user has clicked on the ad and was directed to this site.

 

Each Adwords client receives a different cookie. Cookies can therefore not be tracked via the websites of Adwords clients. The information gathered by means of the conversion cookies is used to prepare conversion statistics for Adwords clients who have opted to use conversion tracking. The Adwords clients find out the overall number of users who have clicked on their ad and were directed to a web page containing a conversion tracking tag. They do not, however, receive any information that would enable them to identify users as individuals.

7. Social Media Plugins

On the basis of DSG or, if applicable, Art. 6, para. 1, sentence 1 f GDPR, we use social plugins from the social networks Xing and LinkedIn on our website to raise awareness of our company via these networks. The underlying commercial purpose is to be deemed a legitimate interest within the meaning of GDPR. The respective provider is responsible for ensuring compliance with data protection legislation. To provide maximum protection to the users of our website, we integrate these plugins by means of the so-called two-click method.  

 

 

a) LinkedIn

We use components of the LinkedIn network. LinkedIn is a service provided by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Every time one of our web pages containing such a component is called up, this component triggers the downloading of a corresponding presentation of the component from LinkedIn by the browser you are using. This process notifies LinkedIn of the specific part of our website that is being visited. If you click the LinkedIn “Recommend” button while you are logged in to your LinkedIn account, you can link the contents of our pages with your LinkedIn profile. This enables LinkedIn to assign the visit to our web pages to your LinkedIn user account. We do not have any influence on the data collected by LinkedIn as a result of this, nor on the scope of such data collected by LinkedIn. Further, we do not have any knowledge of the contents of the data transmitted to LinkedIn. b) XING

We use components of the XING.com network. These components are a service from XING AG, Dammtorstrasse 29–32, 20354 Hamburg, Germany.

Every time one of our web pages containing such a component is called up, this component triggers the downloading of a corresponding presentation of the component from XING by the browser you are using.

As far as we are aware, XING does not store any of the user’s personal data via the retrieval of our website. Likewise, XING does not store any IP addresses. Further, in connection with the “XING share button,” user behavior is not evaluated by means of cookies. c) YouTube

Our website uses so-called social plugins (“plugins”) from YouTube. YouTube is an online video portal that makes it possible for video publishers to upload video clips for free and for other users to watch them for free, to rate them and to leave comments. YouTube allows users to publish any type of clip, which means that users can watch entire films and TV programs as well as music videos, trailers or videos created by users themselves via the online portal.

YouTube is provided YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043-1351, USA.  

By accessing any of the individual pages on this website operated by the data controller and into which a YouTube component (YouTube video) has been integrated, the respective YouTube component automatically prompts the Internet browser on the data subject’s IT system to download a version of the respective YouTube component from YouTube. Further information about YouTube can be found at https://www.youtube.com/yt/about/. This technical process makes it possible for YouTube and Google to find out which specific subpage of our website is being visited by the data subject.

If that data subject is logged in to YouTube at the same time, YouTube knows which of our website’s subpages containing a YouTube video is being visited by the data subject. This information is collected by YouTube and Google and associated with the YouTube account of the data subject.

Via the YouTube component, YouTube and Google are always informed when the data subject visits our website if the data subject is logged in to YouTube at the same time as they access our website, regardless of whether the data subject clicks on a YouTube video or not. If the data subject does not want that information to be transferred to YouTube and Google, they can prevent this transfer by logging out of their YouTube account prior to accessing our website.

  • According to DSG or, if applicable, Art. 16 GDPR, to request the immediate rectification of incorrect or completion of your personal data that is stored by us;
  • According to DSG or, if applicable, Art. 17 GDPR, to request the erasure of your personal data that is stored by us, where the processing is not required for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
  • According to DSG or, if applicable, Art. 18 GDPR, to request the restriction of the processing of your personal data, where you are contesting the accuracy of the data, the processing is unlawful but you oppose its erasure and we no longer require the data, however you require the data for the establishment, exercise or defense of legal claims or, in accordance with Art. 21 GDPR, you have objected to the processing;
  • According to DSG or, if applicable, Art. 20 GDPR, to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format or to request its transmission to another controller;
  • According to DSG or, if applicable, Art. 7, para. 3 GDPR, to withdraw your previously provided consent at any time. This will have the effect that we will no longer be permitted to continue the data processing that was based on this consent and,
  • According to DSG or, if applicable, Art. 77 GDPR, to lodge a complaint with a supervisory authority. To lodge a complaint, you can usually contact the supervisory authority in your usual place of residence or place of work or the location of our company headquarters.

 

 

9. Right to Object

If your personal data is processed on the basis of legitimate interests in accordance with DSG or, if applicable, Art. 6, para. 1, sentence 1 f GDPR, you have the right in accordance with DSG or, if applicable, Art. 21 GDPR to object to the processing of your personal data, where there are grounds relating to your particular situation or you are objecting in relation to direct marketing purposes. If the latter is the case, you have a general right to object, which shall be actioned by us without a particular situation being stated. 10. Data Security

We use the common SSL procedure (Secure Sockets Layer) within our website in conjunction with the respective highest level of encryption that is supported by your browser. You can recognize whether an individual page within our website is transmitted in encrypted form by the depiction of a key or closed lock symbol in the lower status bar of your browser. We also use appropriate technical and organizational security measures to protect your data against accidental or intentional tampering, partial or total loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
